By accessing our website or engaging our services, you agree to the terms set forth herein. *Effective Date: March 30, 2026 · Last Updated: October 28, 2026* ## 1. Acceptance of Terms By accessing or using the Jetpack Media website (jetpackmedia.com) or engaging any of our services, you agree to be bound by these Terms and Services ("Terms"). If you do not agree to these Terms, please do not use our website or services. These Terms apply to all visitors, clients, and any others who access or use our services. ## 2. Services Jetpack Media provides brand strategy, documentary filmmaking, and content marketing services built around our proprietary Core Identity System™, a three-phase Design, Define, & Deploy framework: - **Core Identity Treatment (Design)** — A documentary-style interview with key members of your team, conducted by our Executive Producers, resulting in a written Core Identity Treatment: a brand narrative document, similar to a film treatment. - **Core Identity Film (Define)** — A cinematic brand documentary short, shot on location and directed by our team, built from your Core Identity Treatment. - **Jetpack 360 (Deploy)** — Ongoing content creation and multi-platform deployment (shorts, stills, articles, audio, social posts, and behind-the-scenes footage) derived from your Core Identity Film footage. Specific deliverables, timelines, and fees for each phase are set forth in the applicable Service Agreement, Statement of Work ("SOW"), or, for the Core Identity Treatment, the order confirmation you receive at booking. In the event of a conflict between these Terms and a signed SOW or order confirmation, the SOW or order confirmation shall prevail. ## 3. Confidentiality & Promotional Use of Client Work Jetpack Media treats all client engagements as confidential by default. Client identities, project details, interview content, and proprietary business information will not be shared with third parties without your consent, and Jetpack Media does not credit itself within delivered content, including in end credits. Jetpack Media reserves the right to reference and display completed work for its own promotional purposes (for example, on our website, in our portfolio, or in marketing materials), subject to the following: - We will not publicly identify you as a client or reference your specific project without your prior written consent. - Where you provide written consent, we may feature completed deliverables — including your Core Identity Treatment, Core Identity Film, or 360° Content System materials — as examples of our work. - All confidential business information, interview content, and communications exchanged during your engagement remain protected regardless of any consent to promotional use. - Any non-disclosure agreement ("NDA") executed between you and Jetpack Media is incorporated herein by reference and supplements these Terms. In the event of a conflict, the NDA shall prevail with respect to confidentiality obligations. If you would like your engagement to remain entirely private, notify us in writing before or at the start of your project, and we will not reference you, your brand, or your deliverables in any public-facing materials. ## 4. Intellectual Property Upon receipt of full payment for the applicable phase (Core Identity Treatment, Core Identity Film, or 360° Content System), Jetpack Media assigns to you all right, title, and interest in the corresponding deliverables, including all copyrights therein, unless otherwise specified in writing. Prior to full payment, all work product remains the property of Jetpack Media. Jetpack Media retains the right to use general methodologies, frameworks (including the Core Identity System™ and the Design, Define, & Deploy process itself), and non-confidential know-how developed in the course of providing services, and to reuse production techniques and non-identifying footage or materials that do not disclose your confidential information. You represent and warrant that any materials you provide to Jetpack Media (brand assets, source materials, background information, or other content) do not infringe upon any third-party intellectual property rights. ## 5. Payment Terms **Core Identity System**, **Core Identity Film** and **Jetpack 360**. Pricing for these phases is custom to your project and set out in a separate Service Agreement or SOW. Unless a payment plan is expressly agreed to in writing, full payment is due before work begins. At Jetpack Media's sole discretion, a structured payment plan may be offered to qualified clients and will be set forth in the applicable SOW. Work will not begin, and no production resources will be allocated, until payment (or the first installment under an approved payment plan) has been received and cleared. Missed or late installments under a payment plan may result in an immediate pause of services, and Jetpack Media may withhold delivery of completed work product until outstanding balances are paid in full. All fees are non-refundable once your interview session has been conducted or production has otherwise commenced, except as expressly agreed in writing or required by applicable law. You may reschedule your Core Identity Treatment interview at no charge with at least 48 hours' notice; sessions cancelled with less notice, or missed without notice, forfeit the ability to reschedule without an additional fee. ## 6. Client Responsibilities To ensure successful delivery of services, you agree to: - Provide accurate, complete, and timely information, materials, and feedback as reasonably requested. - Make relevant team members available for the Core Identity Treatment interview and, if applicable, the on-location Core Identity Film shoot. - Provide reasonable access to your worksite or premises for any scheduled on-location shoot, and ensure a safe working environment for our crew. - Review and approve deliverables within the timeframes specified in the applicable SOW. - Designate a primary point of contact for the engagement. Delays caused by your failure to provide required materials, access, availability, or approvals may result in adjusted timelines or additional fees. ## 7. Limitation of Liability To the fullest extent permitted by applicable law, Jetpack Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website, even if advised of the possibility of such damages. Jetpack Media's total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total fees you paid to Jetpack Media in the three (3) months preceding the claim. ## 8. Warranties & Disclaimers Jetpack Media represents that services will be performed in a professional and workmanlike manner consistent with industry standards for documentary and brand content production. However, to the fullest extent permitted by law, all services and website content are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose. Jetpack Media does not guarantee specific business outcomes, revenue results, audience size, or content performance (views, engagement, or reach) from any services rendered. ## 9. Termination Either party may terminate an engagement by providing written notice in accordance with the terms of the applicable SOW. Upon termination: - You will pay for all work completed through the termination date, including any interview session already conducted. - Jetpack Media will deliver all completed work product for which full payment has been received. - Confidentiality obligations survive termination indefinitely. ## 10. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising hereunder shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or litigation in the competent courts of the State of Connecticut. ## 11. Newsletter & Communications Consent By providing your email address through our website's contact, inquiry, or guide-download forms, you consent to receive a reply to your inquiry and any follow-up communications directly related to your request. Separate consent is required for marketing or newsletter communications, as described in our Privacy Policy. You may withdraw consent for marketing communications at any time. ## 12. Website Use You agree to use the Jetpack Media website only for lawful purposes and in a manner that does not infringe the rights of others. You may not: - Attempt to gain unauthorized access to any part of the website or its underlying systems. - Use the website to transmit harmful, offensive, or unlawful content. - Reproduce, distribute, or exploit any website content, trademark, or proprietary methodology without written permission from Jetpack Media (see Section 15, Trademarks & Copyright). ## 13. Changes to These Terms We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our services after updates constitutes acceptance of the revised Terms. ## 14. Entire Agreement These Terms, together with any applicable SOW, order confirmation, NDA, or other written agreement between the parties, constitute the entire agreement between you and Jetpack Media with respect to the subject matter herein and supersede all prior understandings, representations, or agreements. ## 15. Trademarks & Copyright **Trademarks.** Jetpack Media™, Core Identity System™, Core Identity Treatment™, Core Identity Film™, Jetpack 360™, Design-Define-Deploy™ (referred to descriptively elsewhere in these Terms and on our website as "Design, Define, & Deploy"), and Jetpack Your Brand™ are trademarks of Jetpack Media. You may not use any of these marks, or any name, logo, or phrase confusingly similar to them, without our prior written permission. **Copyright.** The Jetpack Media website, the Core Identity System™ guide, and all other original text, graphics, logos, video, audio, and other content we publish or produce (excluding deliverables assigned to a client under Section 4 above) are the property of Jetpack Media and are protected by U.S. and international copyright law. Except as permitted under Section 4, you may not copy, reproduce, distribute, publicly display, or create derivative works from any of this content without our prior written permission. **Proprietary methodology.** The Core Identity System™ framework, including our Design-Define-Deploy™ process, our interview methodology, and the specific creative and production processes we use to produce a Core Identity Treatment, Core Identity Film, or Jetpack 360 engagement, is proprietary to Jetpack Media. By using our website, downloading our guide, or engaging our services, you agree not to copy, reverse-engineer, adapt, teach, or use our methodology, framework, or trademarked terms to build, market, or operate a competing product or service, or for any purpose other than evaluating or engaging Jetpack Media's own services. Because unauthorized use of our trademarks or proprietary methodology may cause harm that money alone cannot fix, you agree that Jetpack Media may seek injunctive relief against such use, in addition to any other remedy available at law. ## 16.
